Here's the language from the statute creating GIBA: "(13) The authority may assess and impose upon lands in the district ad valorem taxes of no greater than 2 mills of assessed value per year, as provided by this act and chapter 197, Florida Statutes. The authority may only impose ad valorem taxes if both of the following conditions are met: (a) Following a referendum in which a majority of the electors of the district voting in the election approve of the levy of ad valorem tax. (b) The authority determines that the bridge tolls being collected may be insufficient to repair, replace, or maintain the bridge and causeway." The voters decide IF the power to levy an ad valorem tax should be granted to the GIBA board. The voters don't set the millage rate, however, as part of the referendum. The statute gives this power to the supervisors and only the supervisors. There would be nothing to stop a future board from reducing the tax to nothing and jacking the tolls to $10. Or raising the tax by two mills each year, and dropping tolls back to $3.20. There is nothing stopping the GIBA board from sticking a millage rate on the referendum. But it's not binding on them or future boards.
